These Terms of Service (“Terms”) govern your use of the Ninja Afrikaans website (https://ninja-afrikaans.co.za) and any online Afrikaans courses provided by LLLA Courses (Pty) Ltd (Reg. No. 2021/883036/07), trading as Ninja Afrikaans. By accessing or using the Website or enrolling in our courses, you agree to abide by these Terms. If you do not agree, please do not use this Website or our services.
1. Eligibility and Acceptance
You must be at least 18 years old to create an account and make purchases. Minors may only participate with the consent and supervision of a parent or legal guardian, as South African law provides that a minor under 18 lacks capacity to enter binding contracts without a guardian’s assistance or subsequent ratification. By enrolling a child in a course or accessing the Website on behalf of a minor, you (the parent/guardian) confirm you have legal authority and that the minor’s participation is permitted and supervised.
Each learner must register under one personal account and keep all account information accurate and current. You may not create more than one account for the same learner or share login credentials with others. We reserve the right to suspend or terminate accounts if we suspect misuse, unauthorized sharing, or violation of these Terms. You are responsible for all activity under your account and must secure your password. Payment for courses must be made by the person who will use the course; do not allow minors to use an adult’s payment method without their permission.
2. Course Access and License
Upon enrolment in a Ninja Afrikaans course, you are granted a limited, revocable, non-exclusive, non-sublicensable, non-transferable licence to access the course content for your personal, non-commercial use only. This licence is personal to the learner and may not be shared, transferred, or resold. All course materials (text, images, audio, video, quizzes, etc.) and the Website itself are the intellectual property of LLLA Courses and Ninja Afrikaans. Except as expressly permitted, you shall not copy, modify, transmit, distribute, reproduce, reverse-engineer, create derivative works from, frame, or embed our content in any form. You agree to acknowledge Ninja Afrikaans as the source of all course content and not to present any part of the courses as your own work or that of another. You may not make fraudulent course purchases or attempt to remove any copyright or licensing notices from our materials.
Usage Limitations: The courses are self-directed and designed to run on a desktop or laptop computer with a reliable internet connection. Users are responsible for providing their own computer, internet service, and any required software (e.g. up-to-date web browser or PDF reader). We strive to make our courses high-quality, but we do not guarantee that the service will be uninterrupted, error-free, or compatible with all devices or browsers. We may update, suspend, or discontinue any course or feature at our discretion (e.g. retiring old content or adding new modules); we will not be liable if a course is modified or terminated. Continued access to courses is contingent on adherence to these Terms and timely payment.
3. Student Conduct and Live Sessions
Our courses are mostly self-study, but we may offer occasional live group video lessons (e.g. Q&A sessions or workshops). During any live or interactive session, all learners must treat others with respect and courtesy. Disruptive behaviour (such as harassment, abusive language, or any conduct that interferes with teaching or learning) will not be tolerated. We reserve the right to remove or mute participants who behave inappropriately during lessons, and if necessary to block users who persist in disruptive conduct. Learners must comply with any instructor’s instructions during group activities. Specifically prohibited behaviours include any unlawful, harassing, defamatory or harmful actions, and the introduction of any unsolicited advertising or spam into class sessions.
4. Payments and Refunds
Pricing: Our online course fees are non-refundable, as this protects the copyright of our course materials. We aim to support and empower prospective learners and their parents in making informed purchasing decisions by providing detailed course information, open communication channels, and, for selected courses, a pre-course assessment. If the full course price was paid (as opposed to a discounted price), a refund (minus a small administration fee) is available only if you have paid for the course and have not yet begun accessing its content. Once you log in and begin the course (e.g. by opening the first lesson or quiz), the course is considered accessed and no refund will be issued, regardless of completion status. This policy aligns with industry standards that treat accessed course content as a delivered service.
To request a refund (if eligible), please contact our support team in writing within a reasonable time. Any refunds will be processed using the original payment method within 15 business days of approval. We will not be responsible for any costs incurred by you (such as foreign transaction fees). These refund terms are subject to any overriding consumer rights under the South African Consumer Protection Act (for example, any mandatory cooling-off period for distance sales) and the proviso that you have not already started the course content.
If you default on payment, we reserve the right to suspend your access to course materials until payment is made. If payment issues persist, your enrolment may be cancelled in accordance with the Consumer Protection Act and these Terms.
5. Progress Tracking, Badges, and Certificates
Our learning management system (powered by LearnDash LMS and SCORM standards) automatically tracks your quiz results and overall course progress. This data is stored in our system to help you monitor progress and for certificate issuance; it is not shared externally except as necessary for administering the course. As you advance, you will earn digital badges celebrating milestones, and upon completing all course requirements you will receive a Certificate of Completion. This certificate recognizes completion of the Ninja Afrikaans program but is not an accredited or formal qualification. It cannot be copied or issued by any other party and has no value outside of indicating you finished our course.
6. Acceptable Use and Prohibited Activities
While using our Website and courses, you must comply with all applicable laws and these Terms. Prohibited activities include, but are not limited to:
- Account abuse: You may not share your login, create multiple accounts for the same learner, or allow others (including siblings or classmates) to use your account. Each learner must have a unique account.
- Unauthorized access: You must not attempt to access parts of the Website or course system that are not intended for you. In particular, deep-linking, framing, mirroring or embedding our pages or content without permission is forbidden. Automated tools (bots, scrapers, crawlers) that extract or copy content from our site are prohibited.
- Malicious code: You may not upload, transmit, or otherwise introduce any harmful software (such as viruses, worms, trojans) or any code or script intended to disrupt the Website.
- Spamming or advertising: You may not use the Website to send unsolicited messages (spam), chain letters, pyramid schemes, or unauthorized advertising.
- Harassment: You must not harass, stalk, abuse, defame, or threaten other learners or instructors during any live session or via any communication channel.
- Illegal or fraudulent use: You must not use the Website or courses for any unlawful purpose. Fraudulent course purchases, misuse of content, or any attempt to circumvent our systems will result in immediate termination of your access.
- Intellectual property violations: You may not upload, post, or submit any third-party content (e.g. copying external text, videos, music) to the site or course materials. (Note: Ninja Afrikaans does not provide student-to-student forums or content-sharing features, and any such content is prohibited.)
We reserve the right to restrict or suspend your access if we suspect any prohibited use or abuse of the service. Repeated violations may result in account termination without refund.
7. Intellectual Property Rights
All course content and Website materials – including text, audio, video, graphics, quizzes and code – are protected by copyright and other intellectual property laws. LLLA Courses (Pty) Ltd trading as Ninja Afrikaans owns or licenses all rights to this content. You are granted no ownership rights in the content. You may use materials only as expressly authorised in these Terms. Any unauthorized copying, reproduction, distribution or creation of derivative works from our courses is prohibited. In particular, you may not sell or resell our courses or content under your own or another name.
If you believe content on our site infringes a copyright you own, please contact us. We will take down or block such content in compliance with South African copyright law and any international obligations.
8. Disclaimers and Limitation of Liability
No Guarantees of Results: We make every effort to design engaging and effective Afrikaans courses. However, all course content is provided “as is,” without any guarantees of specific learning outcomes or completion timelines. While we offer guidance and planning tools to support learning, ultimate responsibility rests with the learner. Progress depends on each individual’s personal attributes, initial proficiency, and level of effort. We do not guarantee the achievement of any particular skill level, grade, or rate of progress.
No Warranties: To the maximum extent permitted by law, Ninja Afrikaans and LLLA Courses disclaim all warranties, whether express or implied, regarding the Website and courses. This includes warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the course content will be error-free or that access will be uninterrupted.
Limitation of Liability: Under no circumstances will Ninja Afrikaans, LLLA Courses, or their officers and affiliates be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Website or courses. This includes loss of data, loss of profits, personal injury, or any other damages, even if we were advised of the possibility of such damages. Our total liability to you will not exceed the amount you paid for the course. This disclaimer does not limit any non-waivable statutory consumer rights you may have under South African law.
Third-Party Services: We use reputable third-party providers for certain services. For example, payment processing is handled by Stripe (or a similar vendor), and your financial information is never seen or stored by us. Payments you make are subject to the terms and privacy policies of the payment processor. We are not responsible for any errors, delays, or omissions by the payment processor.
Technology and Security: We use industry-standard security measures, but due to the nature of the internet we cannot guarantee absolute protection of user data or content. We will try to protect our system and your data, but you should also take steps to secure your own devices and network (e.g. use antivirus software, keep software updated, secure Wi-Fi). We will not be liable for any issues caused by external factors beyond our control (such as network outages, hacking, or your device failures).
9. Indemnification
You agree to indemnify and hold harmless Ninja Afrikaans, LLLA Courses (Pty) Ltd, and our employees, agents and affiliates from any claims, liabilities, damages, losses or expenses (including legal fees) arising out of: (a) your breach of these Terms, (b) your violation of any laws or rights of a third party, or (c) your misuse of the Website or courses. For example, if your actions cause a claim by a third party against us, you will defend and pay for any costs we incur as a result. This obligation survives the termination of your account. This indemnity is subject to and does not limit any rights you may have under applicable consumer protection laws.
10. Modifications to Terms and Service
We may revise these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Website. Your continued use of the site and courses after such changes will constitute your acceptance of the new Terms. It is your responsibility to review these Terms periodically. If you do not agree to the updated Terms, you must stop using the Website and courses.
We also reserve the right to change, suspend or discontinue any aspect of the services at any time, without notice. For example, we may discontinue a course or lesson. If a course is discontinued, you will not be entitled to any compensation or refund beyond what is stated under the Payments and Refunds section above.
11. Governing Law
These Terms and your use of the Website are governed by the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts, except as otherwise required by law.
